Renfrewshire Council

Local Development Plan 2014

The Renfrewshire Local Development Plan and Supplementary Guidance set out strategies, policies and proposals for the next 10 years.

Adoption of Renfrewshire Local Development Plan

Renfrewshire Council adopted the Renfrewshire Local Development Plan (LDP) on the 28 August 2014. The Renfrewshire Local Development Plan replaces the Renfrewshire Local Plan (2006).

At the meeting of the Planning and Property Policy Board on the 26 August 2014, Renfrewshire Council resolved to adopt the Renfrewshire Local Development in accordance with the provisions of the Town & Country Planning (Scotland) Act 1997. Details of the 26 August 2014 meeting of the Planning and Property Policy Board can be found on the related articles link opposite.

The Scottish Government's letter confirming that the Council could proceed to adopt the plan after the 27 August 2014 can be viewed in the related content.

Legal Challenge to the Adoption of The Renfrewshire LDP

Please note, following the adoption of the LDP, two statutory appeals against the validity of the Renfrewshire LDP were lodged at the court of session. The meeting of the Planning and Property Policy Board on 11 November 2014 agreed to defend statutory appeals that had been submitted to the Court of Session in relation to the Renfrewshire Local Development Plan.

Braehead

An appeal in relation to Braehead Town Centre status was heard in the Court of Session from 23 to 25 June 2015. The Appeal was allowed and the sections in the Local Development Plan that Refer to Braehead as a Town Centre were quashed and deleted from the plan. The written reasons for the Court's decision and the effect of the Court's ruling on the Adopted Renfrewshire Local Development Plan can be found in the related content.

Gypsy/Travellers

An appeal in relation to the provision of sites for Gypsy/Travellers was heard in the Court of Session on the 28 and 29 September 2016. This appeal was dismissed following approval of a planning advice note at the meeting of the Planning and Property Policy Board on the 8 November 2016. The Planning Advice Note is a non-statutory framework to allow an appropriate assessment of land use planning implications of Gypsy/Traveller proposals

Under current planning legislation an Adopted Local Development Plan cannot be amended by a council in light of the Court's ruling.  The Local Development Plan is therefore partially quashed and will remain in that format until a fresh Local Development Plan is brought forward.

Renfrewshire Local Development Plan

The Renfrewshire Local Development Plan and Supplementary Guidance documents, guide development and the use of land within Renfrewshire. They set out policies used to make decisions on Planning Applications. In assessing development proposals the Council will therefore, in the first instance, consider whether the proposal accords with these two documents which can be downloaded in the related content.
