Appeal a licence application

Here you will find information on how to appeal a decision of the Regulatory Functions Board and Licensing Board for licensing applications.

Civic Government (Scotland) Act 1982

If an application for the grant or renewal of a licence under the Civic Government (Scotland) Act 1982 is refused, or granted conditionally, the applicant/licenceholder are entitled to ask the Council within 21 days of the application being considered at a meeting of the Regulatory Functions Board to give reasons for such refusal, or the imposition of such conditions, and thereafter they are entitled to appeal to the Sheriff against the decision on certain grounds.

Where there are any objections to an application and the application is subsequently granted the objector can also ask the Council to give reasons for such grant and thereafter are entitled to appeal to the Sheriff also.

Licensing (Scotland) Act 2005

If an application for the grant or renewal of a licence under the Licensing (Scotland) Act 2005 is granted or refused the applicant/licenceholder are entitled to ask the Licensing Board within 14 days of the application being considered at a meeting of the Licensing Board to give reasons for such refusal, or the imposition of such grant or refusal and thereafter they are entitled to appeal to the Sheriff Court within 21 days of the date of the decision on certain grounds.
